Terms of service
Terms of Service
1. About These Terms
These Terms of Service apply when you use the GoutShop website or purchase products from us.
By placing an order through GoutShop, you agree to these terms together with our Privacy Policy, Returns & Refunds Policy and any other terms or information brought to your attention before purchase.
Nothing in these terms affects your statutory rights under UK consumer law.
2. About GoutShop
GoutShop is an independent online retailer providing products and information relating to gout, joint comfort, wellbeing and associated areas.
Our legal business name, trading address and contact details are displayed on our website and/or order documentation.
GoutShop is independent and is not affiliated with or endorsed by the NHS.
3. Health Information
Information provided on GoutShop, including articles, guides, charts, product information and other educational content, is provided for general information purposes.
It is not intended to replace medical advice, diagnosis or treatment from a doctor, pharmacist or other appropriately qualified healthcare professional.
If you have concerns about gout, symptoms, medication or another health condition, you should seek appropriate professional medical advice.
Where we link to external organisations, including the NHS, those links are provided to help visitors find additional information. Unless expressly stated otherwise, this does not mean that the organisation endorses GoutShop or our products.
Please also see our Medical Disclaimer.
4. Products
We make reasonable efforts to ensure that product descriptions, photographs, specifications, prices and other information on our website are accurate.
Product images are provided for illustration and presentation purposes. Packaging and appearance may occasionally differ from photographs where, for example, a manufacturer changes its packaging.
Any important differences affecting the nature or characteristics of a product will be communicated where required.
Nothing in these terms excludes your statutory rights concerning goods that are faulty, not as described or otherwise fail to conform to the contract.
5. Product and Health Claims
Products sold through GoutShop should only be used in accordance with the instructions, warnings and intended use provided with the product.
The sale or presentation of a product on GoutShop does not mean that it will prevent, treat or cure gout or any other medical condition unless such a claim is specifically lawful and appropriately authorised or supported.
Individual experiences and results may vary.
You should seek professional advice where appropriate before using a product if you have an existing medical condition, take medication, are pregnant or breastfeeding, or are uncertain whether a product is suitable for you.
6. Placing an Order
When you place an order, you are making an offer to purchase the products in your basket.
After placing an order, you will normally receive an electronic acknowledgement.
A contract for the purchase of goods is formed when we accept your order. We may communicate acceptance through an order confirmation or dispatch confirmation, depending on our checkout process.
If we cannot accept your order, we will notify you and refund any payment taken for the affected goods.
7. Prices and Payment
Prices displayed on GoutShop are shown in pounds sterling (£).
Where VAT is applicable, displayed consumer prices will include VAT unless clearly stated otherwise.
Delivery charges, where applicable, will be shown before you complete your order.
Payment must be made using one of the payment methods available during checkout.
If an obvious pricing or listing error occurs, we will contact you before fulfilling the affected order where appropriate. We will not deliberately use pricing-error terms to remove rights that consumers would otherwise have under applicable law.
8. Availability
Products are subject to availability.
We may withdraw products from sale or update our product range from time to time.
If a product becomes unavailable after you have placed an order and we cannot supply it, we will contact you and refund the amount paid for the unavailable item.
9. Delivery
Available delivery options and applicable charges will be displayed during checkout.
Any delivery dates or times shown are estimates unless we expressly agree otherwise.
We will take reasonable steps to deliver your order within the agreed or legally required timeframe.
Please ensure that the delivery information supplied with your order is complete and accurate.
Further information can be found on our Delivery Information page.
10. Returns, Cancellations and Refunds
Your rights to cancel an online order and return eligible products are explained in our Returns & Refunds Policy.
Certain statutory exceptions may apply to particular products, including some sealed goods that are unsuitable for return for health protection or hygiene reasons once unsealed.
Nothing in these terms or our Returns & Refunds Policy limits your statutory rights in relation to faulty, damaged, incorrectly supplied or misdescribed goods.
11. Using Products Safely
You are responsible for reading and following the instructions, warnings, storage requirements and other safety information supplied with a product.
Products should only be used for their intended purpose.
If you experience an unexpected reaction, worsening symptoms or have concerns about your health, stop using the relevant product where appropriate and seek suitable medical advice.
In an emergency, seek emergency medical assistance.
12. Website Information
We aim to keep the information on GoutShop accurate and up to date, particularly where we publish health-related educational content.
However, medical knowledge, clinical guidance, product information and external resources can change over time.
Publication or review dates may therefore be displayed on our Advice content where appropriate.
13. External Websites
GoutShop may contain links to external websites, including NHS resources and other third-party information.
External websites are operated independently of GoutShop and have their own terms, privacy policies and content.
A link does not, by itself, constitute an endorsement, partnership or affiliation between GoutShop and the organisation operating the external website.
14. Intellectual Property
Unless otherwise stated, the original content, branding, graphics, photographs and other materials created for GoutShop are owned by us or used with appropriate permission.
You may use the website for your own personal, non-commercial purposes.
You must not reproduce, republish or commercially exploit substantial parts of our original content without permission, except where permitted by law.
Third-party names, trademarks and content remain the property of their respective owners.
15. Reviews and User Content
Where GoutShop allows customers to submit reviews, comments or other content, submissions must be genuine and must not contain unlawful, abusive, misleading, defamatory or infringing material.
We may moderate or remove content where reasonably necessary, including where it breaches these requirements or applicable law.
Submitting a review does not guarantee that it will be published.
16. Our Responsibility to You
We do not exclude or limit liability where doing so would be unlawful.
This includes liability that cannot legally be excluded or restricted and your statutory rights relating to the goods we supply.
Nothing in these terms excludes or limits liability for death or personal injury caused by negligence where such liability cannot lawfully be excluded.
17. Events Outside Our Reasonable Control
There may occasionally be circumstances outside our reasonable control that affect our ability to operate the website or fulfil an order.
Where this happens, we will take reasonable steps to minimise disruption and meet our legal obligations to customers.
18. Changes to These Terms
We may update these Terms of Service from time to time, for example to reflect changes to our website, products, business practices or applicable law.
The terms applicable to a purchase will be those made available to you when the relevant contract is entered into, subject to any changes required by law.
19. Governing Law
These terms are governed by the applicable laws of the United Kingdom.
If you are a consumer, you retain any mandatory protections and rights available to you under the law applicable to you.
Nothing in these terms is intended to prevent a consumer from exercising any right to bring proceedings in a court available to them under applicable law.
20. Contact Us
If you have a question about these Terms of Service, an order or GoutShop, please contact us using the contact details provided on GoutShop.uk.
